SMYRNA, Ga -- The father of the man shot and killed by a Smyrna police officer is appealing to Cobb County leaders for help in the case.

Nicholas Thomas was shot and killed by on March 24 while police were trying to serve him with a warrant for a probation violation.

His dad, Huey Thomas, went before the Cobb County Commission this week asking for their help in getting justice for his son's death.

Police identified Smyrna Sgt. Kenneth Owens as the one who fired shots at the car with Thomas inside.

"Kenneth Owens stated he felt threatened by my kid," said Thomas to the five member commission. "He was not threatened. Period. He claimed that my son backed up toward officers…The autopsy states that my son was shot up under his right armpit.. that suggests, Mr. Owens shot a .40 caliber pistol toward my son's right armpit and it traveled across and killed him."

Although the Thomas family has criticized how Cobb District Attorney, Vic Reynolds has handled the case, Reynolds did grant the family's request to turn the investigation over to the GBI.

Cobb District Attorney, Vic Reynolds, told 11Alive he has met with Mrs. Thomas and several activists in the case three times and understands the emotion everyone feels.

Reynolds expects the GBI's investigation to wrap in the next two weeks, and then he plans to take the findings before a grand jury, which he said does during every police-involved shooting.
